From what you say, the GTA IV map (Liberty City) cannot be used. But could a map created by someone be used as long as it is not from any other game and does not violate intellectual property laws?

These companies see there branding being used in a illegal way in the game and these servers aka

Being used for illegal activity such as:

  • Bank Robberies
  • Drug Dealing
  • Drive by shooting
    and many more that they see being broadcasted on platforms such as Twitch, Youtube etc

They see it is damaging there brand and want to put a end to it, but like someone said before you should have never been able to use these copyright/ trademark material that you’re not allowed to use in SP or FiveM

These recent changes sound like they not only affect vehicles, but also clothing, character & weapon models, and more. Does this affect loading screens, and scripts as well? How will this policy be enforced?

They’re probably going to start blacklisting (sorry, denylisting) models by SHA256/MD5 hash, and will terminate your server license if detected.

So what are we supposed to do about this? We’re supposed to quite literally design & model our own cars/clothes/weapons/etc? We can’t use any of the GTA 5 brands because they’re technically R*'s “intellectual property”? Yeah right. Eat me.

It seems like vehicles are their #1 priority with this change. Which I find humorous and ironic because most of the base & DLC GTA vehicles are clones of real-world cars, with slightly altered models & badges.

I’m all down for following IP and copyright laws boys. But this change has killed FiveM.

People have spent hundreds (some thousands) on vehicles, clothes, scripts, etc. thru Tebex. And for CitizenFX (who integrated with Tebex) to now ban 99% of sold items, and then not offer any assistance on this issue, is completely outrageous, considering they have PROFITED OFF OF THIS.

It is so sad to see FiveM die in this way. Like a kid dying of asphyxiation.

I’d beg to differ, if a community does not make any money from a project. I would have to say that it falls under fair use. Regardless of the TOS, assets, so long as they are not making money could still fall under fair use which would allow others to continue using them.

That would be in a perfect world, where everyone wasn’t running a server to make a buck.

It wouldn’t come under fair use, using a car in your roleplay server is not transformative.

This is unfortunate. I mean even past branded stuff, I’m not the biggest fan of taking that freedom away from the player / server. Some people for example host private / singleplayer servers with family / friends and don’t advertise or stream this kind of data. Sad stuff; Same with maps and content from other games that a given client paid for…

I know that rockstar is legally obligated to make clear their stance on such types of usage, however, a large part of what made fiveM special was that it allowed players the freedom to do what they wanted - it kind of followed the spirit of GTA games itself expaneded into multiplayer in a way (almost) no other framework delivered. I hope that legally overtime, this doesn’t just devolve into another GTA:Online, because if so, here’s what will happen.

Some OTHER dev / group of devs will collaborate to make yet another open source multiplayer framework for this / the next GTA, Rockstar will buy them, the same thing will happen and the process will repeat…
The only thing that may change is if rockstar strips away the players right to modify the game directly using DRM or something similar.

But the problem is that these organizations are battling people’s rights and freedom;

there’s only so much action you can take in the name of defending your brand before it starts to become unconstitutional, or right-infringing, understanding WHY people are upset is actually understandable considering fiveM went from a type of expression to just some corporate’s rules / regulations.

With this move, it’s diminishing the same breeding grounds that brought us hundreds of thousands of mods large to small that brought us some better immersion, improved the experience, or even added a nice touch.

This is the same reason r* got so much slack for trying to destroy this very project in the past. Because they went after the player’s freedom - Unfortunately, through an alternative approach, they may have just succeeded.

But see the issue that im seeing and noticing is that GTA SP or Online make models like IRL cars tho, so how is that even possible if us people can tell what cars they are remodeling?

Here is one of the examples im talking about, to the left obviously a Porche but to the right is a Pfister Growler and it looks just like the Porche just a lil minor changes to it.

They’re legally different. Same thing as calling Toyota Proace just another Renault Trafic but with minor changes. It is not a 1:1 copy of the car and has major differences.

You can put them side by side with their irl counterparts and they look almost identical lol :laughing:

Correct but they said to not have a model like of irl cars and thats wat they are producing. So de-badging and having a minor difference is okay is what ur saying? Just tryna make sure so ofc. Look at the image of the car, literally yell’s Porche.

im pretty sure copyright laws say that it has to be 5% different.

Are you sure about that? Because by this logic, coming from other games where modding is actually supported, (( Garry’s Mod, DayZ and so forth )) it would be only reasonable to assume that they would be victim to a class action lawsuit despite using the exact same vehicles/content for a server which accepts no monetization for an ingame advantage.

I wish not to argue, but discuss. As it seems rockstar wants to kill any platform with TOS before their launch for the awaited GTA 6, which I’m sure will not be as pleasureful to us as it would be to those who do not have access to the same tools we do to fluff the world around us. (Console)

The Zentorno is heavily based on the Lamborghini Sesto Elemento, featuring the overall shape, hexagonal vents in the back of the car, twin roof scoops and triangular vents on the hood. The car’s default color scheme when spawned at the player’s garage in singleplayer is also reminiscent of the distinctive carbon-fibre-and-red colors of the Sesto Elemento. The front fascia, greenhouse area, rear diffuser, side vents and grille resemble that of the Lamborghini Veneno. Additionally, the car can be customized with a unique spoiler highly reminiscent of that on the Lamborghini Veneno. The headlights are based on the 2015 Acura NSX Concept. The A-pillar of the car may be based on the Lamborghini Huracán. The rear fascia is largely based on the Sesto Elemento, while also taking elements from the Veneno. The sides of the car and the tail lights are derived from the Lamborghini Aventador.

Sure, it may resemble a Porsche and it may have been rockstars intention to make it look like a Porsche, but the car is different in many ways, it doesn’t have the exact width of the trim for the two panels of windows, vent is located in a different spot, head lights are more triangular, front bumper has some differences, etc…

Just because said design looks like something doesn’t mean that it is violating IP laws, it’s not the same design. Debadging a car still maintains the cars original design, which is highly likely to get you in trouble.

They get around. Like I mentioned earlier in the thread all vehicles in GTAV are a inspired by 2 or more different models. For the car you’re mentioning for example. People could easily do the same thing, model it based off real life counterparts, but then change the rear taillights, change the hood shape, etc. There are ways to get around design copyrights and Rockstar are very good at it.

The Growler is prominently based on the Porsche 718 Cayman, with the headlights, rear diffuser and exhaust derived from the 2017 Alpine A110. The front bumper seems to come from the Gemballa Mirage GT.

Tbh they are wanted here and it is great that they have the ownership of it all to see what holds for GTA 6 ngl

Okay thats understandable and i get that but thats why i wanna ask them in a way bcuz if we get a car that has “Many changes” but very little to notice in the change bcuz yes i see what ur talking about but its just a Porch with no kit, or older model.

I cant get into detail of what they changed of but a width change is no big difference its still the model of the car. So make a model of the car with many changes, correct?
