Would it be a ToS violation to have both a Tebex store and a Patreon?

I better ask before regretting my actions.

I was wondering whether it would be a violation of the Terms of Service of FiveM to have a server where in-game perks and items would be completely sold through FiveM’s partner Tebex, but at the same time accept support via Patreon, that doesn’t give players any perk in-game.

I’ll make an example, so it’s more clear.
On Tebex:

  • access to special jobs
  • access to special properties
  • access to special clothes/peds/vehicles (rightfully owned)

On Patreon:

  • special Discord role
  • voting powers over server features
  • early access to videos showing future features
    (no in-game stuff)

Also wondering whether it would be within the ToS to sell actual merch (t-shirts, hoodies, …) using a third party service like spreadshirt, without infringing FiveM/R*'s trademark of course.

Any approved end-user transaction for in-game privileges or User Generated Content through
built-in commerce functionality in FiveM, at this time exclusively provided through Tebex Ltd.

I would guess that this means you are okay because you are not granting any in-game privileges or user generated content.

No, that’s in the set of exceptions to the other rule, which remains unchanged:

No financial remuneration shall be obtained by the Users from any derivative of, or third party service, User Generated Content, or Game Server for FiveM, the Game Services, or other entities stated in these Terms, except as expressly permitted by CitizenFX. Entities with permission are included under ADDENDUM D: LIST OF EXCEPTIONS FOR TERM ‘8’.

Note the ‘any Game Server for FiveM’ part. If people like you for other reasons - sure, but if this remuneration is as any result of the game server, nope, and if it’s not at least somewhat part of any of the exceptions (i.e. in-game functionality or UGC), nope either.

This makes it difficult when you have a community with game servers on other games though.

For example Garry Mod and Fivem, if I want to offer VIP forums and discord access, am I only allowed to offer that to people who play our gmod server?

An easier method would be to just not have the same community name/set be used for “multiple games” if you intend to monetize.

to add to this: tebex allows you to give special discord roles and then you can give them a channel where you have a voting bot and a channel that shows the videos.
