Leaking question

Isnt it not a bad thing to leak because selling vehicles for money is againsed TOS

Leaking other peoples work is always a bad thing. Its disrespectful and distasteful. Just because they sell their stuff doesn’t give you the right to leak their product no matter what the TOS is. Just don’t buy it… Plain and simple.

I believe FiveM has implemented a new system called Tebex to allow selling product for FiveM now. I don’t know what products that can be as I am never on the forums much anymore but yeah…

Leaking and using leaks is stupid. Don’t do it.

To make it clear, leaking by itself is technically not illegal / against any rules, as if an asset is not sold legitimately (not via ToS-approved Tebex), then the author cannot really claim copyright / unapproved usage violations or whatever. That said, using paid content on your server is against ToS, and in this case it does not matter how you got it - either by paying for it yourself or getting it from a leak… community. (?) The safest option is to stay away from any paid content that is (or was) sold by methods not approved by the FiveM Terms of Service and only use free, publicly released stuff from this forum and the likes of lcpdfr.com or gta5-mods.com

Going away from the legal stuff, morally, obtaining and using leaked stuff is “bad” for the reason xander1998 outlined, but when it comes to me personally I do not consider it theft. You cant steal something that is not being distributed/sold legally in the first place, right?
For the record, I do NOT condone or encourage leaking and obtaining/using said content (neither am I personally engaged in any form of this). That is simply my opinion on the topic.

Most of your answer is incorrect.

  1. stealing someone else’s property (code) is illegal if the other person legally owns it, and the person who stole it could be sued if the owner has enough evidence that the theft took place and they lost revenue because of the action, regardless of the fact that the script was being sold without FiveM’s approval.

  2. if someone makes a visual asset or a script and sells it outside of Tebex, it’s not illegal at all, it’s just against FiveM’s Terms of Service, and the most FiveM can do is ban their account, but they would not take it to court as they would lose the case. The copyright owner is the person who made the work. But then, if the work includes stuff created by FiveM (e.g. think of a fork of FiveM’s source code grabbed from the public repos), then that’s another thing. A script that is simply made to work with FiveM (99% of the resources being sold) is not using code owned by FiveM.

  3. FiveM approves sales of paid content (scripts, mods, in-game perks) via their partner Tebex. It’s incorrect to tell someone to stay away from paid content altogether.

Disclaimer: I am not an attorney, the post above represents my personal understanding. You should seek legal advice in your area instead.

the other guys are admins for fivem forums i think they would know more than you. not trying to sound like rude but just saying

Read the message carefully and educate yourself on the matter before attacking me, will you?

  1. My WHOLE point is stuff being sold illegally / against ToS - sure, maybe someone does have actual ownership of the code, but that ownership goes right out the window if the code is being sold by means not approved by the platform. Try suing someone over that, see what happens lol

  2. That is why I recommended to “stay away from any paid content that is (or was) sold by methods not approved by the FiveM Terms of Service” . It is ALWAYS safer because, say, even if you are using some-vehicle-pack that can only be bought from the owner of those models from some-website.com , even if you personally had no idea of that and grabbed the pack from some-leak-website.com , you are still in the wrong, because the asset(s) are originally paid content.

  3. Where did I recommend to stay away from paid content altogether, my guy?

That is the safest option, but again, notice that I never recommended to stay away from paid content altogether - if something’s sold via Tebex, you have full rights to use it and nothing “bad” will happen, simple as that.

P.S. I believe I saw a reply to this very matter by d0p3t somewhere sometime ago on another topic, but I cant seem to find it now

And maybe they have an interest in saying what they are saying?
(Btw I don’t see any moderator badges near anyone’s name here)

I didn’t attack anyone, I corrected you.

I could make an entire CAD system and sell it for $100/month on my website, and it would be a completely legal business under the law, and it would be fully my ownership / intellectual property.

Yeah, I agree that someone is certainly on the safer side by only using the approved methods, which is what I do too. You don’t want to get your account banned or your server shut down of course. But what I meant is that this doesn’t make it illegal.

“Legal” law-wise, sure, but as long as it’s intended to be used in FiveM you will be putting yourself and anyone else who pays for it in great danger by breaking the ToS (if it’s not sold via Tebex, of course, but since you said “your website” and you dont seem to be the owner of Tebex, that doesn’t seem likely ). To be clear - whenever I said “legal” or “illegal” I was referring to the FiveM ToS, not any country’s actual law. Probably should’ve clarified that before to avoid confusion…
