DPS being sued by family of suspect that was killed

On Friday January 31 Blaine County Circuit Court Judge Max Miller heard a case of an unlawful or excessive death of a suspect early this year. The family of Johnathan Woodstock who say was killed by the San Andreas Department of Public Safety said that DPS broke their own protocol and failed to help Johnathan when needed. The Woodstock family’s Attorney Ben Button filed paperwork in January stating, “Such damages arise out of San Andreas DPS’s: (1) actions leading to the death of Johnathan Woodstock in January 2025; (2) negligence in the duty of care towards Johnathan Woodstock; (3) breach of protocol and standard procedures by the San Andreas DPS; (4) failure in providing adequate and timely assistance leading to the wrongful death; (5) failure to follow procedure by the Trooper on 1 January 2025, including not calling for medical assistance despite the altercation leading to a heart attack; and (6) inadequate lifesaving measures attempted by the responding Trooper at the scene.”
Judge Miller heard from both sides, but was unable to make a decision due to Sand Andreas’ Department of Public Safety representation failed to show up for the hearing on Friday. Colonel Smith of DPS stood in for them and said there will be an attorney for the next hearing on the matter. Judge Miller gave time for both parties to gather evidence to present it in court at the next hearing.
The next hearing is on Saturday February 8, 2025 at 6:00 PM CST at the Blaine County Courthouse in Paleto Bay.
