Regarding the ToS

So about selling game servers, you are allowed to do it?

Cause it does state “Don’t try to make money off FiveM. Not even your game services. Covering costs incurred from
third parties (server rent, product licensing, …) is fine, however any additional profit (including
‘donations’ other than to cover immediate costs) is not.”
So as long as the money gained from selling servers is used to pay server bills and other products used to provide the service you are allowed to sell them?

No, providing game servers is not allowed.

Even if its covering the bills or free…

No selling of FiveM servers at all unless explicit permission is granted in addendum D of the ToS.

Isn’t that kinda like breaking the Competition law?

What law defines how a modification for a game must operate? Any program/developer can issue a terms of service. If you don’t want to follow that terms of service, you don’t use the program.

FiveM isn’t a product being sold. This is just completely irrelevant.

Well there is a market for servers and you guys are basically making it non competitive by only allowing (at current date) 1 provider to sell servers?

FiveM can decide who can and can’t use their software. This includes running their servers (which is also their software). You also have the option of purchasing a VPS and setting up a server yourself. You simply are not allowed to sell/buy pre-configured servers.

Everyone can set up a server for free, it’s the opposite of a monopoly.

I would suggest reading through the following 2 topics, as they likely hold every single argument and counter-argument. I don’t wish to re-argue and reiterate everything that has already been stated.

What if we sell a server but allow the customer to themself upload files? If we do that we dont sell preconfigured servers.

Soooo you’re a VPS provider? That’s not a violation, unless you advertise it as a FiveM server. If you’re giving them access to a vanilla Linux distro (or Windows), and they do the rest, it’s not a violation.

Well what if I advertise it was MultiFive and then let them via FTP upload files, for example it detects if its FiveM or ■■■■■■ they have uploaded and then does the correct settings according to that.

You cannot sell a FiveM server. Period. If you do, it is going to get blacklisted anyway. The only servers you can sell are fresh VPSes WITHOUT any FiveM files.
