Emergency Order Questions and hosting your own Fivem server... "No politics take the politics out of it want to know Legal Discussion and thoughts only please!"

So I just got this handed down we have Business class fiber here at our residence and we host web servers and email servers along with some game servers but after reading this Emergency Directive I am questioning what exactly the rules are there are so many grey areas and then so many areas that seem to be cut and dry…

I removed the text of the document and provided link only do to the fact that this information may be region locked…

The title of this act is: Executive Order on Securing the Information and Communications Technology and Services Supply Chain

Emergency Order Signed lastnight

The way I am reading some of this at the moment is fivem is technically a service so even the in game transaction is considered a value in some ways…

Are they asking us to just Whitelist American ip’s only?? What will the rest of you do? Will you all ignore this and continue hosting?

I am not an attorney just looking for advice with the new Emergency Order that was posted 05-15-2019…

Thanks
Loren Tedford

Executive Orders only apply to the federal government, as a privately held organization/private individual you should not be directly affected.

I am not sure though on this… You might take a read down a bit under the individual sub section… This sounds like its being implemented through:

International Emergency Economic Powers Act (50 U.S.C. 1701 et seq. ) (IEEPA), the National Emergencies Act (50 U.S.C. 1601 et seq. ), and section 301 of title 3, United States Code,

Trump has issued a decree giving his government extensive powers to take action against foreign telecom companies. The White House said on Wednesday that the measure was not directed against any particular country or company. But it is believed that Trump wants to hit China and the Huawei company based there.

This will allow the government to prevent extensive business activities between US companies and companies from “opposing” states - which is controversial even in the USA. Anyone who wants to sell or transfer US technology to Huawei (or another foreign company) will have to buy a license for it in the future.

This has nothing to do with you, nor the FiveM services.

Actually what your discussing is not related to the Emergency Order Thread…

Here is the ruling for what your quoting back to me… If you pay attention to the wording in the above document this applies to individuals…

What your mentioning I believe is totally separate issue @doxylamin

The way some are reading this is that in can be to any country not just China. The way the current order is written…

Here is the listing of Definitions provided in case you didn’t read that far into the document.

Sec. 3. Definitions. For purposes of this order:

(a)the term “entity” means a partnership, association, trust, joint venture, corporation, group, subgroup, or other organization;

(b)the term “foreign adversary” means any foreign government or foreign non-government person engaged in a long‑term pattern or serious instances of conduct significantly adverse to the national security of the United States or security and safety of United States persons;

(c)the term “information and communications technology or services” means any hardware, software, or other product or service primarily intended to fulfill or enable the function of information or data processing, storage, retrieval, or communication by electronic means, including transmission, storage, and display;

(d)the term “person” means an individual or entity; and

(e)the term “United States person” means any United States citizen, permanent resident alien, entity organized under the laws of the United States or any jurisdiction within the United States (including foreign branches), or any person in the United States.

Let’s stick to the topic of this Order for simplicity I just want to know the thoughts of everyone… There is too much other things going i get it but we gotta stick to the topics…
